Charter and Daysail Terms -Searay 340 "Yorkie III"

1) Reservation - Reservations are confirmed and booked when a 50% deposit is recieved with a signed contract. Contracts can be faxed to 941-866-8109; or emailed to charters@360yachting.com; or mailed to 360 Yachting, 12464 Kelly Sands Way, Fort Myers, FL 33908.

2) Departure Time - Be at the boat 10 minutes prior to departure to leave at the scheduled time. Lateness is not reimburseable either in cash or charter time.

3) Clothing - Dress appropriately for the weather. Shoes may be worn onboard only if they are boat shoes that will not leave scuff marks on the decks. Charters that have to return to the dock because of innapropriate clothing are not refundable.

4) Weather - It is the to the sole discretion of the captain if the weather is safe to sail. Charters are not refundable but may be transferred to another date if the weather is deemed by the captain to be unsafe. Charters will not be called off because of overcast conditions, no wind, rain, or the like.

5) Provisions - The amount and type of provisions provided by the charter company are listed specifically in the charter description and online menu selection. You are welcomed to bring additional food and drinks. No refunds or cancellations will be given for lack of or dislike of the menu.

6) Maintenance - If the boat is delayed for maintenance a prorata credit will be given for the time missed under the following conditions: a) Charter notifies Charter Company in a timely fashion and allows charter company opportunity to repair the problem. b) problem in question pertains to necessary operating equipment on the vessel. 360 Guarantees the Engine, Transmission, Depth Sounder, Steering, Rigging, Sails. The guarantee does not cover non essential equipment. If the head becomes blocked due to improper use, charterer may be liable for repair expense starting at $175. Charter Company will not be held liable for any damages or failures due to operator error or negligence, including but not limited to chase boat calls, towing, service personel, parts and materials, etc.

7) Damage - Any damage or loss to vessel or equipment that is beyond the control of the Captain or Charter Company will be promptly paid for by the customer.

8) Destination and Agenda - It is very difficult to predict how long and far a sailboat will have to travel to make a specified destination. Wind Speed, Direction, and Sea State, directly affect the boats ability to reach predetermined destinations. 360 Yachting makes no guarantees that the vessel will be at a specified location at a specific time. Other than delivery and return of the vessel, no refunds will be issued for lack of reaching a destination at a specific time.

9) Drugs - No illegal drugs will be permitted on the vessel. Upon finding any illegal controlled substances, the Captain is obliged to immediate cancel the charter, notify the proper authorities, and return immediately to port. No refunds will be given for time lost.

10) Alcohol - Alcoholic beverages are permitted on board. Passengers must not drink more than they can handle. If a passenger becomes intoxicated and unruly the Captain is obliged to cancel the charter or put the offending person ashore at the nearest possible landing. No one under legal drinking age shall drink alcoholic beverages.

11) Captain's Legal Authority - While at sea, the Captain is the only legal authority aboard the vessel. Primary concerns are for the safety of the passengers and crew first, and the vessel second. Any action by a passenger that hinders or distracts the captain from performing his duties may be dealt with by the Captain however he/she deems reasonable.

12) Final Payment (term charters) - Final Balance is due 30 days prior to the charter departure date for all charters longer than 8 hours. If the booking is made within 30 days of the date, reservation requires full payment.

13) Final Payment (daysails) - Final Balance on daysails is due no later than prior to depature. Vessel will not depart until final balance has been paid.

14) Gratuity - It is customary in the United States to pay a gratuity to the captain, crew or instructor of 10% - 20% of the total charter fee, depending on how well the crew catered to your needs.

15) Damage Deposit - All Term Charters will require a Damage Deposit equal to the deductable on the Insurance Policy, usually 2% of the value of the vessel and equipment..

16) Damage Deposit Waiver - For a fee of $50 per day of charter the full damage deposit shall be waived for a lesser amount of $1500.

17) Cancellation Policy - Any cancellation before 90 days of the charter date will be refunded less a $200 processing fee. Cancellations made within 90 days of the charter will be refunded only if the charter company is able to rebook the boat for the specific dates of the charter. Charter company highly recommends purchasing a Vacation Insurance Policy.
